Não há, no mundo real, escolha possível: não escolho doenças mais baratas ou mais caras, nem posso escolher não ficar doente. Se o direito tem de ser garantido para todos, é necessário, na prática, que seja gratuito o acesso aos serviços de saúde pública.
Com relação à educação, o preço de uma mensalidade escolar certamente também traz uma exigência de gratuidade para o que o direito seja garantido universalmente. Mas já não acho um fator tão forte quanto o que se verifica no caso da saúde. Muita gente já estudou ou não quer estudar mais: estará pagando impostos para que outros estudem, o que é justo, e estará se beneficiando de uma sociedade onde toda pessoa, se quiser, pode estudar de graça. Mas não é pessoalmente um beneficiário virtual do serviço de educação.

Mas não considero que esse raciocínio torne logicamente obrigatório que os serviços sejam absolutamente gratuitos –que a tarifa seja zero. Desde que o transporte público seja barato –e, em alguma medida, é–, esse direito está garantido. No caso da saúde isso não ocorre. Ademais, muita gente –que mora perto do emprego, que não se desloca, que é velho ou é criança—não é necessariamente usuário regular do transporte público. É justo que transfira renda para o usuário regular, por meio de impostos? Sim, se os seus impostos garantem mais obras de metrô, etc., que beneficiam toda a sociedade, mesmo quem não anda de metrô. Não sei se é justo quando os impostos financiam totalmente uma passagem que qualquer pessoa tem, por si mesma, condições de pagar.
Claro que, para manter a passagem barata, certa dose de subsídio estatal é necessária. O governo pode arcar com 30, 40, 60 por cento dos custos de uma passagem. Mas que cada usuário arque com 30, 40 ou 70 por cento dos recursos da sua própria passagem não é necessariamente injusto, se isso custar relativamente pouco. Mesmo custando pouco, o bolo total dos recursos auferidos faz diferença –o que não acontecia no caso de uma pequena porcentagem de estudantes da USP pagar pelos seus estudos.
A questão é eminentemente prática, de custos, de realidades diferentes (as necessidades de saúde, educação, transporte têm suas particularidades). Não é, a meu ver, uma questão de princípios. Defender o direito ao transporte não faz com que só seja justo um mundo de tarifa zero.
